This Site Use Agreement describes how our educational site and its contents may be used for personal development by individuals, communities and businesses. It also describes our position on warrantees and your responsibilities for using our site, including posting content on our future message board.

1. Overview & User Responsibilities

The following Site Use Agreement sets forth the terms and conditions for using the ManifestYourPotential.com site. Please read this agreement since it governs your use of this site and its contents. If you use ManifestYourPotential.com and its contents, it shall be deemed that you agree with our terms. If you do not agree, please do not use this site and our materials.

If we modify this agreement, its terms take effect immediately upon posting. From your continued use of the site, it shall be deemed that you accept the modified terms of the agreement. It is your responsibility to periodically review this agreement to keep up to date and follow its terms.

We provide insights, ideas and information to help you find your gift and talents, create your dream job and start living your extraordinary life. You are responsible for evaluating how well our ideas fit your individual situation, applying only what makes sense to you, and knowing when you are ready to make changes that improve your life. Please think carefully through all your options before making any decisions that will transform you life.

2.1 Servicemarks: ManifestYourPotential.com is a for profit, commercial site and Manifest, Manifest Your Potential and ManifestYourPotential.com and all related logos, products and services described in this site are either servicemarks or registered servicemarks of ManifestYourPotential.com. They may not be copied, imitated or used, in whole or in part, without the prior written permission of ManifestYourPotential.com. Site content, design, layout and materials are the intellectual property of ManifestYourPotential.com and are protected by copyright law. In addition, all custom graphics are service marks and/or trade dress of ManifestYourPotential.com and may not be copied, imitated, or used, in whole or in part, without our prior written permission.

The content of the entire site is protected by US domestic and International copyright law, unless part of the public domain. The site makes no claim of ownership to public domain content, font based graphics, nor the copyrighted work of others, as cited. Other product and company names mentioned on the site may be the trademarks of their respective owners.

3. Individual, Community & Business Usage

3.1. Definition of Usage: We distinguish between individual, community and business use of our educational site contents and tools. This helps clarify how different user groups may use them.

3.2. Restricted Activities: You may not sell, resell, license, give away, redisplay, host or re-host our content or materials. This applies to all site content and materials, including all web pages, quizzes, guidebooks, how to articles, tools and products.

3.3 Permitted Activities: To help make using our site easier, we grant the following permissions:

Downloading, Personal Printouts & Storage: You may download our pages onto your local hard drive, make one paper copy, and make backup digital copies for archival and storage. Each printed page or digital file must include the full copyright information without addition, deletion or modification.

Student Use: Students can print out and use our web pages for educational projects. Each printed copy must include the full copyright information without addition, deletion or modification. Online projects should use direct links instead of re-hosting our content but temporary cached pages is fine.

Making & Sharing Paper Copies: You may purchase an "authorzied copy" license to print out and share paper copies of our web pages with your students, staff, co-workers, clients and constituents. Each printed copy must include the full copyright information without addition, deletion or modification.

Please note, however, we DO NOT grant you permission to copy or distribute our content or materials online, on disk, or digitally, as a package with any service or hardware, or otherwise.

3.4 Reprint & Quoting Permission: You may not reprint our copyrighted content or materials without our prior written authorization, except as outlined by the Fair Use Rule of the United States Copyright Laws. However, to aid in applying that rule, we grant permission to individuals, editors, writers and businesses to quote up to 300 words from our web pages in a publication, as long as they credit our web site address so that readers can find us online.

Please note that this is NOT GRANTING PERMISSION TO REHOST, REPRINT, OR DISPLAY part or all of any web page, guidebook, product or tool.

If you wish to reprint our materials in your publication, you must contact us about requesting or purchasing reprint permission.

3.5 Product User License Agreement: If you purchase a product user license or use one of our products, you agree to the terms of use below. Our product license allows you to download the product, use it, print out one paper copy and make a backup digital copy for your individual use. However, it does not grant you title or ownership of the product, so this license does NOT GRANT PERMISSION TO REHOST, REPRINT, DISPLAY, TRADE, GIVE AWAY, SELL, RESELL or EXPLOIT FOR COMMERCIAL PURPOSES part or all of this guidebook. To make and share paper copies of our products, or use them for commercial purposes, you must purchase an appropriate "authorized copy" user license for each printed paper copy you make. The making, distribution and sharing of digital copies is prohibited. Your product user license only applies to the version downloaded at the time of purchase. If you want to download the most recent or a different version, you must purchase a new product license. All our copyright information and hyperlinks must be clearly visible and active, with no additions, deletions or modifications.

3.6 Authorized Copy User License Agreement: If you purchase an authorized copy user license for one of our products or web pages, you agree to the terms of use below. Authorized copy user licenses do not include a download, so you must purchase a product license at the same time or have previously downloaded it. For web page copy licenses, you may print out your printing master at any time. You must purchase an "authorized copy" user license for each printed paper copy you make. You agree to track the number of copies you make and also agree to not make more copies than you have purchased a license for. (We will be happy to sell you additional licenses if you need to make more copies.) These licenses DO NOT grant you title or ownership of the material. You may not sell or resell "authorized copies", however you may bundle them into the career counseling and life skill services you already offer. The making and distribution of digital copies is prohibited. All our copyright information and hyperlinks must be clearly visible and active, with no additions, deletions or modifications.

The type of "authorized copy" user license for products must match the intended use and user type:

Individual Use: This is for use by individuals, such as friends family and group members for personal development.
Business Use: This is for commercial use by individuals and businesses, such as life coaches, career counselors, human resource staff, corporate trainers and managers for use with clients, customers and internal company employees.
Non Profit Community Use: This is for community building and educational use by non profit organizations, public and private schools, non profit community groups, tribes, public institutions and government agencies for use with students, constituents, community members and internal employees.

3.7 Other Rights Reserved: All rights and licenses of ManifestYourPotential.com not explicitly granted here are reserved, and in particular NO permission (except as the Site may, in its discretion, give in writing) is granted to use the words "Manifest", "ManifestYourPotential.com" or "Manifest Your Potential".

4. Disclaimer of Warranties, Damages, and Content

4.1 Limited Liability & Responsibility: While we make reasonable efforts to ensure that the information and materials here are accurate, we assume no liability or responsibility for any errors, ambiguities, omissions or defects. We also cannot and do not guarantee or warrant that files available for downloading through our site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. In no event is ManifestYourPotential.com liable for any damages whatsoever arising out of the use of this site or the content thereof, including direct, indirect, incidental, consequential or punitive damages. Therefore we strongly recommend that you keep your virus software up-to-date and make regular backups of your computer files.

4.2 No Warranty: Without limiting any of the foregoing, the content of the site is provided "AS IS" and YOU ASSUME ALL RISK OF DEFECTS and ACCEPT THE SITE AS IS. Individual, Community & Business Usage were not adhered to, the site will be entitled without bond, other security or proof of damages, to appropriate equitable remedies with respect to breaches of such section, in addition to any other available remedies.

4.5 Site Content: The Site and its contents are provided for their educational value. The views, opinions and beliefs expressed on it in online message boards may be offensive or inaccurate, but in any event they are not necessarily those of the Site. If you experience a problem with our message board content, please let us know about it.

5. User Interaction & Supplied Materials

5.1 Your Responsibilities: In connection with your use of our site, you agree you will not:

a) Transmit any message, information, data, text, software or images, or other content (Material) that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable that may invade another's right of privacy or publicity;

c) Upload or transmit any Material that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;

d) Delete any author attributions, legal notices or proprietary designations or labels that you upload to any communication feature;

e) Violate any applicable local, state, national or international law;

f) Post or transmit any Material that contains a virus or corrupted data;

g) Impersonate ManifestYourPotential.com or service provider personnel, a forum leader, guide or host or falsely state or otherwise misrepresent your affiliation with a person or entity;

h) Use the Site’s communication features in a manner that adversely affects the availability of its resources to other users (e.g., excessive shouting, use of all caps, flooding continuous posting of repetitive text, or excessive use of site resources);

i) Post or transmit any unsolicited advertising, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes" or any other form of solicitation. (However, one time posting of web site URLs for informational or feedback purposes is encouraged);

j) Delete or revise any Material posted by any other person or entity;

k) Register, subscribe, attempt to register, attempt to subscribe, unsubscribe, or attempt to unsubscribe, any party for any Manifest Your Potential service or product if you are not expressly authorized by such party to do so;

l) Manipulate or otherwise display the Site by using framing or similar navigational technology.

5.2 License: So that we may display your bulletin board posts and success stories, as well as use your feedback and suggestions, you agree to grant to ManifestYourPotential.com a non-exclusive, royalty-free, worldwide, sub licensable, perpetual license, with the right to sub-license, to reproduce, distribute, transmit, create derivative works of, publicly display and publicly perform any materials and other information (including, without limitation, ideas contained therein for new or improved products and services) you submit to any public areas of the site (such as message boards, forums and newsgroups) or by e-mail to ManifestYourPotential.com by all means and in any media now known or hereafter developed.

5.3 Your Granting Us Permission To Use Your Name: If you grant permission to ManifestYourPotential.com the right to use your name in connection with the submitted materials and other information, we can use it in our advertising, marketing and promotional materials. If you later decide you would like to have your name and materials removed from our advertising, marketing and promotional materials, we shall do so promptly.

5.4 Indemnification: Further, you agree that you will hold harmless and indemnify ManifestYourPotential.com and its affiliates from and against violation of your representations hereunder, including any infringement of the copyrights or other intellectual property or other rights of any person or entity or other unlawful activity arising out of the use or display of any text or other materials provided by you to us.

6. Providing Service or Products

6.1 Decline To Provide Services and/or Products: ManifestYourPotential.com specifically reserves the right to decline to provide Services or Products with respect to any content, guidebooks, tools, other materials, or event participation, for good and lawful business reasons, including but not limited to:

a) infringing on our, or our service providers, copyright, trademark, or other proprietary rights and not making prompt remedy;

b) being defamatory or libelous to us or our service providers;

c) creating, participating in, or perpetuating viruses, Trojan horses, worms, time bombs, cancel bots, or other similar harmful or deleterious programming routines against us or our service providers.

7.1 Links To Other Sites: ManifestYourPotential.com has not reviewed all of the content of Web sites that may be linked to the site, and specifically disclaims responsibility for the content of any such linked sites. If you encounter problems with an existing link, please let us know about it.
